Terms of service

MemeChef is run by Code Cowboy Limited, a company registered in Hong Kong at Room 1505, 15/F, Yu Sung Boon Building, 107–111 Des Voeux Road Central, Hong Kong. These terms cover the MemeChef iOS app and the memechef.app website. By using either, you agree to them. If you don't agree, don't use MemeChef. Questions: contact@codecowboy.dev. Who can use MemeChef

You must be at least 18 years old. MemeChef is an adults-only service: no accounts for anyone under 18, and no photos of anyone under 18 anywhere in the service (see "Photos of people" below). If we learn either rule has been broken, we delete the account or content.

What MemeChef is

MemeChef turns your photos into AI-generated memes. You upload photos to create identities, pick recipes (our prompt templates, grouped into packs), and spend credits to cook memes. There's also an AI camera, an AI-assisted meme editor, and a meme wiki on the website. Third-party AI providers help generate images. Recipes, packs, models, and features may change or be withdrawn as we update the service.

Your account

You sign in through one of the providers available in the app and are responsible for what happens under your account. You can delete your account at any time in the app (Profile → Settings). Deleting the app from your phone does not delete your account. Use the in-app option instead. Deleting your account doesn't cancel an active App Store subscription: cancel that in your Apple account settings, or Apple will keep billing you.

Subscriptions

Paid plans are auto-renewing subscriptions bought through Apple, billed to your Apple account at the price shown on the paywall before you buy. Each plan renews automatically at the end of its period until you cancel in your Apple account settings (Settings → your name → Subscriptions), at least 24 hours before the period ends. Introductory offers renew at the standard price shown at purchase. Apple is the merchant for all purchases: refunds for purchases are handled by Apple under its terms, and we can't issue them ourselves. If we change a plan's price, you'll see it before you're charged and can cancel first. Cancelling stops future renewals and credit grants. Your membership stays active until the end of the current billing period. Any unused subscription credits expire when that period ends.

Credits

Cooking costs credits. Subscription plans grant credits at the start of each billing period. Unused subscription credits expire when that period ends and do not roll over. When you have both types, MemeChef uses subscription credits before top-up credits. The credit cost of each generation is shown in the app before you confirm it. If a cost changes, we'll show you the new amount before charging it.

Top-up credits do not expire while your account is open, but you need an active membership to buy or use them. If your membership ends, your top-up credits stay on your account and become available again when you resubscribe. Credits have no cash or real-world value. They cannot be transferred, sold, or redeemed. If you delete your account, or if we close it because you broke these terms, any remaining credits are lost. This does not affect rights that the law does not allow us to limit.

Failed cooks and credit refunds

If a generation fails because of a problem on our side, the credits come back automatically. Credits aren't returned when something you do causes the failure. For example, this can happen if you delete an identity mid-cook or submit a prompt that our safety filters or our providers' filters refuse to run. None of this affects any statutory rights your local law gives you that can't be waived.

Your content

You keep ownership of everything you upload. So we can run the service, you give us a worldwide, non-exclusive licence to host, store, copy, resize, and process your uploads and creations, and to send them to the AI providers that generate your images. We may do this only to operate and provide MemeChef. If you delete a creation, it disappears from your library. The licence for stored copies ends when you delete your account, except for a limited period while backups and provider retention periods roll over. We do not use your photos or creations to train AI models.

Photos of people

When you upload a photo that shows a real person, you're promising us that you have their permission to upload it and put their face in AI-generated memes. Photos of anyone under 18 are not allowed at all, even your own kids, even with permission. You are responsible for how you use another person's likeness; don't create digital replicas of real people without their consent.

AI-generated images

As between you and us, the memes you create are yours: we assign to you whatever rights we may have in them. There are some limits. Purely AI-generated images may not be protected by copyright at all. Recipes are shared, and other people using the same recipe may get similar results. Your output may not be unique. AI output is unpredictable: it can be inaccurate, offensive, or accidentally resemble a real person, brand, or existing work. We make no promise that any output is original or non-infringing, outputs don't represent our views, and our filters may block prompts or results.

Acceptable use

Don't use MemeChef:

  • for anything illegal, or for harassment, bullying, or hate speech;
  • for sexual content involving anyone who is, or looks, under 18. This rule is absolute, and we report this content where the law requires;
  • for intimate or sexual imagery of any real person without their consent, or any content that facilitates non-consensual intimate imagery;
  • to impersonate or deceive, including passing off generated images as real, creating digital replicas of real people without consent, or spreading political disinformation;
  • to get around our safety filters or our providers' filters;
  • to break, probe, overload, scrape, or reverse engineer the service, or to access it by any means other than the app and website.

If you break these rules, we may remove content, forfeit credits, or close your account without warning or refund.

Reporting content

If MemeChef was used to create something that harms you, especially intimate imagery made without your consent, email contact@codecowboy.dev or use the in-app support chat. We remove reported non-consensual imagery within 48 hours, and we act on other credible reports quickly, including deleting content and banning accounts.

Copyright complaints

If you believe content on MemeChef infringes your copyright, email contact@codecowboy.dev with: what work is infringed, where the material is (links or descriptions), your contact details, a statement that you believe in good faith the use is unauthorised, a statement that your notice is accurate and (under penalty of perjury) that you're authorised to act for the owner, and your physical or electronic signature. We remove infringing material, and we close the accounts of repeat infringers. If your content was removed by mistake, reply with a counter-notice and we'll take a second look.

Our stuff

MemeChef itself, including the name, logo, apps, recipes, models, wiki text, and everything we've built to run it, is ours or licensed to us. These terms give you a personal, non-transferable, revocable licence to use the app on Apple-branded devices you own or control, as the App Store rules allow, and nothing more.

Third-party services

Using MemeChef also means complying with terms that apply to you from third parties: Apple's media services terms for purchases, your sign-in provider's terms, and our AI providers' acceptable-use policies, which our own rules above mirror.

No warranty

MemeChef is provided "as is". We can't promise it will always work, be secure, be error-free, or produce what you had in mind. AI generation in particular comes with no guarantee of quality, accuracy, or fitness for any purpose. To the fullest extent the law allows, we disclaim all implied warranties.

Limited liability

To the fullest extent the law allows, we're not liable for indirect, consequential, or punitive damages, or lost profits or data, and our total liability for anything connected to MemeChef is capped at the greater of what you paid us in the 12 months before the claim or USD 100. Nothing here excludes liability we can't legally exclude, including liability for death or personal injury caused by negligence or for fraud. Nothing here deprives you of mandatory consumer rights in your country of residence.

Indemnity

If someone brings a claim against us because of content you uploaded (including claims from people whose photos you used without permission), images you created, or your breach of these terms, you'll cover the losses and reasonable legal costs that claim causes us.

Governing law and disputes

These terms are governed by Hong Kong law, and disputes go to the Hong Kong courts. If mandatory consumer law where you live gives you the right to sue at home, these terms don't take that right away.

If you live in the United States, you and we agree to resolve disputes by binding individual arbitration instead of court, administered by the American Arbitration Association under its Consumer Arbitration Rules (and its Mass Arbitration Supplementary Rules where many similar claims are filed), with the Federal Arbitration Act governing this clause. Before filing, email us and give us 30 days to sort it out informally. Either side can still bring an individual claim in small-claims court, and either side can seek an injunction in court for IP infringement or misuse of the service. You and we each waive the right to a jury trial and to participate in a class action. You can opt out of this arbitration agreement entirely by emailing contact@codecowboy.dev with the subject "Arbitration opt-out" within 30 days of first accepting these terms. Opting out doesn't affect anything else in them.

Apple App Store terms

You're getting the app from Apple's App Store, so Apple requires us to tell you the following. These terms are between you and Code Cowboy Limited, not Apple. We are solely responsible for the app and its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price you paid Apple (if any); to the maximum extent the law allows, Apple has no other warranty obligation, and anything else arising from a warranty failure is our responsibility. We, not Apple, are responsible for addressing any claims relating to the app, including product liability claims, claims that it fails to conform to legal or regulatory requirements, and consumer protection or privacy claims. We are also responsible for the investigation, defence, settlement, and discharge of any claim that the app infringes a third party's intellectual property. You represent that you're not located in a country subject to a US government embargo or designated a "terrorist supporting" country, and not on any US government list of prohibited or restricted parties. Apple and Apple's subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Changes to these terms

We may update these terms as MemeChef changes. We'll give you advance notice of material changes in the app or on this page. The latest version and its date will always be posted here. If you keep using MemeChef after a change takes effect, you accept the new terms. If you don't agree, stop using the service and cancel your subscription before the change applies.

The fine print

If part of these terms turns out to be unenforceable, the rest still stands. Not enforcing a term isn't waiving it. You can't transfer your rights under these terms; we may assign ours as part of a reorganisation or sale. These terms plus the Privacy Policy are the whole agreement between us about MemeChef. Sections that by their nature should survive (content licences you've granted for past processing, liability limits, indemnity, disputes) survive account closure.
